Terms & Conditions

By downloading, installing, or using the DateEmber app or website, you agree to these Terms & Conditions. If you do not agree, please do not use DateEmber.

These Terms form a legally binding agreement between you and DateEmber ("we", "us"). We may update these Terms from time to time — we will notify you before significant changes take effect. Continued use of the app means you accept the updated Terms.

• You must be at least 18 years old to use DateEmber
• You must provide accurate information when registering
• You are fully responsible for your account and all activity on it
• You must not have been previously banned or suspended from DateEmber
• DateEmber staff will never ask for your password

DateEmber is a space for genuine, respectful human connection. When using the app, you agree to:

• Be honest — represent yourself truthfully in your profile
• Be respectful — treat every user with basic decency and kindness
• Accept rejection gracefully — do not repeatedly message someone who has declined
• Not send unsolicited explicit, sexual, or inappropriate content
• Not use discriminatory, abusive, or hateful language
• Meet matches safely — always in a public place for the first meeting

The following are strictly prohibited and may result in immediate account removal:

• Fake profiles or impersonation — using someone else's photos, name, or identity
• Misleading or deceptive content — content that misrepresents who you are
• Scamming or asking for money — soliciting transfers, gifts, or financial favours from other users
• Harassment or threats — sending threatening, abusive, or intimidating messages
• Sharing intimate images without consent
• Child sexual abuse material (CSAM) — will be reported to law enforcement immediately
• Illegal content — content violating the IT Act, IPC, POCSO Act, or any applicable Indian law
• Platform abuse — hacking, scraping, or automated access to DateEmber's systems
• Commercial activity — advertising, promoting services, or soliciting other users for business

• You own your content — photos, bio, and messages belong to you
• By uploading content, you give DateEmber a limited licence to display it within the app to provide the service. This licence ends when you delete the content or close your account
• We will never use your photos in advertising without your explicit written consent
• You are responsible for ensuring you have the right to share any content you upload
• Do not upload explicit content, content belonging to others, or photos of minors

We reserve the right to suspend, restrict, or permanently remove any account that violates these Terms.

• Minor violations — warning issued; content may be removed
• Repeated or moderate violations — temporary suspension
• Serious violations — permanent ban
• Criminal activity — reported to relevant Indian law enforcement

To appeal a decision, email support@dateember.com. We will review and respond within a reasonable time.

DateEmber offers optional premium memberships and digital products that enhance your experience. These purchases are entirely optional and are not required to use the basic features of the application. Premium products are available only through Google Play Billing.

All digital purchases within DateEmber are processed securely through Google Play Billing.

DateEmber does not collect or store:

• Credit card information
• Debit card information
• UPI PINs
• Banking credentials
• Google Pay credentials

Google processes all payments according to its own billing and security policies. Prices displayed inside the application may change due to taxes, regional pricing, promotional offers, or currency conversion.

Subscriptions automatically renew at the end of each billing cycle unless cancelled before renewal through your Google Play account.

Through Google Play, users may:

• Cancel subscriptions
• Upgrade subscriptions
• Downgrade subscriptions
• Manage payment methods

Cancelling a subscription prevents future renewals but does not cancel the current paid period. Premium benefits remain available until the subscription expires.

All purchases made through Google Play are subject to Google's refund policies. DateEmber cannot directly issue refunds for purchases processed by Google Play.

If you believe a purchase was made accidentally or in error, you may request a refund through your Google Play purchase history where eligible. Refund eligibility is determined solely by Google Play and applicable consumer protection laws.

Boosts, Swipe Packs, and Super Likes are digital products. Unless required by law:

• They have no cash value
• They cannot be transferred to another account
• They cannot be exchanged for money
• They cannot be resold
• They may expire after use
• Consumed items cannot be restored

Unused digital items remain associated with the purchasing account unless otherwise specified.

DateEmber may suspend or permanently terminate accounts involved in:

• Payment fraud
• Chargeback abuse
• Stolen payment methods
• Purchase manipulation
• Fake transactions
• Circumvention of Google Play Billing
• Exploitation of pricing errors
• Abuse of promotional offers

To provide premium services, DateEmber verifies purchases with Google Play. Verification may include:

• Purchase token
• Product identifier
• Purchase status
• Subscription status
• Expiry date
• Transaction information

If verification fails, premium features may be suspended until the purchase can be successfully verified.

Premium features may change over time. DateEmber may:

• Add new premium features
• Remove existing features
• Improve premium services
• Modify feature availability

...without affecting your rights under applicable consumer protection laws.

The free version of DateEmber currently includes:

• Up to 10 free swipes each day
• Profile creation
• Matching
• Messaging after a mutual match
• Basic profile browsing

Premium memberships provide additional features but are not required to create or maintain an account.

The DateEmber name, logo, branding, design, software, source code, graphics, icons, and other intellectual property belong to DateEmber or its licensors.

You may not, without prior written permission:

• Copy
• Reverse engineer
• Modify
• Redistribute
• Sell
• License
• Create derivative works

You may stop using DateEmber at any time and delete your account.

DateEmber may suspend or permanently terminate accounts that violate these Terms, applicable laws, or community guidelines.

Termination does not affect any payment obligations incurred before termination.

• DateEmber is provided "as is" — we make no guarantees about finding a match or relationship outcome
• We are not responsible for the behaviour of other users on or off the app
• We may take steps to improve user safety such as reviewing reported content, but cannot guarantee complete safety
• The app may occasionally be unavailable due to maintenance or technical issues
• To the extent permitted by Indian law, DateEmber's liability is limited to the amount you paid us in the past 12 months
• Your rights under the Consumer Protection Act 2019 are not affected by these limitations

We may update these Terms from time to time to reflect changes in the app, legal requirements, or our policies. We will notify you in-app before significant changes take effect. Continued use of DateEmber after changes are posted means you accept the updated Terms.

If you do not agree to the updated Terms, you should stop using the app and may delete your account at any time.

• These Terms are governed by the laws of India, including the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, the Consumer Protection Act 2019, and the Indian Contract Act 1872
• Any disputes shall be subject to the jurisdiction of the competent courts in India
• We encourage you to contact us first — most issues can be resolved quickly and fairly by email
• Consumer disputes may be raised with the National Consumer Disputes Redressal Commission (NCDRC)
• Cybercrime complaints can be filed at cybercrime.gov.in
